The Alcoholic Beverage Control Division (ABC) in Kansas, an agency within the Kansas Department of Revenue (KDOR), recently seized 1,006 OPMS liquid kratom extract products from 12 businesses across Kansas. The ABC claims these products contain 15.7% to 16.1% ethanol, exceeding Kansas's strict alcohol laws, which require a license for products with over 0.5% alcohol by volume (ABV).
While ethanol is commonly used in kratom extraction, the levels found in the seized OPMS shots are reported to surpass ABV limits even for wine or microbrewery beer in Kansas. This enforcement action follows the recent passage of a bill (SB497) in the Kansas Senate that would classify kratom as a Schedule I substance, although kratom is currently legal and unregulated in the state. An earlier Kratom Consumer Protection Act introduced in 2025 in Kansas failed to advance.
The investigation began in September 2025, culminating in raids on March 11. ABC Director Debbi Beavers stated, 'Sales of unlawful alcoholic beverages by unlicensed businesses pose a clear risk to consumers and undermine the integrity of Kansas’ regulated marketplace.' This operation signals a heightened enforcement environment for kratom products in Kansas, particularly those with higher alcohol content.
